Hadith 17716

حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنْ جَرِيرِ بْنِ حَازِمٍ ، قَالَ : حَدَّثَنَا عَدِيُّ بْنُ عَدِيٍّ ، قَالَ : أَخْبَرَنِي رَجَاءُ بْنُ حَيْوَةَ ، وَالْعُرْسُ ابْنُ عميرة ، عَنْ أَبِيهِ عَدِيٍّ ، قَالَ : خَاصَمَ رَجُلٌ مِنْ كِنْدَةَ ، يُقَالُ لَهُ : امْرُؤُ الْقَيْسِ بْنُ عَابِسٍ ، رَجُلًا مِنْ حَضَرَمَوْتَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي أَرْضٍ ، فَقَضَى عَلَى الْحَضْرَمِيِّ بِالْبَيِّنَةِ ، فَلَمْ تَكُنْ لَهُ بَيِّنَةٌ ، فَقَضَى عَلَى امْرِئِ الْقَيْسِ بِالْيَمِينِ ، فَقَالَ الْحَضْرَمِيُّ : إِنْ أَمْكَنْتَهُ مِنَ الْيَمِينِ يَا رَسُولَ اللَّهِ ذَهَبَتْ وَاللَّهِ أَوْ وَرَبِّ الْكَعْبَةِ أَرْضِي . فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ حَلَفَ عَلَى يَمِينٍ كَاذِبَةٍ لِيَقْتَطِعَ بِهَا مَالَ أَخِيهِ ، لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ " . قَالَ رَجَاءُ : وَتَلَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلا سورة آل عمران آية 77 . فَقَالَ امْرُؤُ الْقَيْسِ : مَاذَا لِمَنْ تَرَكَهَا يَا رَسُولَ اللَّهِ ؟ قَالَ : " الْجَنَّةُ " . قَالَ : فَاشْهَدْ أَنِّي قَدْ تَرَكْتُهَا لَهُ كُلَّهَا .
It is narrated from Hazrat Adi (may Allah be pleased with him) that a man named Imru’ al-Qais bin ‘Abis from the tribe of Kindah had a dispute over a piece of land with a man from Hadhramaut in the presence of the Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) advised the Hadhrami to present witnesses, but he had no witnesses. The Prophet (peace and blessings be upon him) then told Imru’ al-Qais to take an oath. The Hadhrami said, "O Messenger of Allah (peace and blessings be upon him), if you allow him to take an oath, by the Lord of the Ka’bah, he will take my land." The Prophet (peace and blessings be upon him) said, "Whoever takes a false oath in order to unlawfully seize his brother’s property will meet Allah while He is angry with him." Then the Prophet (peace and blessings be upon him) recited this verse: "Indeed, those who exchange Allah’s covenant and their oaths for a small price..." Imru’ al-Qais asked, "What will the one who gives up his right receive?" The Prophet (peace and blessings be upon him) replied, "Paradise." Imru’ al-Qais said, "Then bear witness, I have given up all the land in his favor."
