لَيْثٌ ، عَنْ
رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ ، عَنْ
حَنْظَلَةَ بْنِ قَيْسٍ ، عَنْ
رَافِعِ بْنِ خَدِيجٍ ، أَنَّهُ قَالَ : حَدَّثَنِي
عَمِّي ،
أَنَّهُمْ كَانُوا يُكْرُونَ الْأَرْضَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمَا يُنْبِتُ عَلَى الْأَرْبِعَاءِ وَشَيْئًا مِنَ الزَّرْعِ يَسْتَثْنِيهِ صَاحِبُ الزَّرْعِ ، فَنَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ ، فَقُلْتُ لِرَافِعٍ : كَيْفَ كِرَاؤُهَا بِالدِّينَارِ وَالدِّرْهَمِ ؟ فَقَالَ رَافِعٌ : لَيْسَ بِهَا بَأْسٌ بِالدِّينَارِ وَالدِّرْهَمِ.
It is narrated from Hazrat Rafi’ (may Allah be pleased with him) that my uncle told me that in the blessed era of the Prophet (peace and blessings be upon him), people used to lease out land for a share of the produce or for a portion of the field which the landowner would reserve for himself. The Prophet (peace and blessings be upon him) forbade this. I asked Hazrat Rafi’ (may Allah be pleased with him) about leasing land in exchange for dinars and dirhams. Hazrat Rafi’ (may Allah be pleased with him) said that there is no harm in this.
