(حديث مرفوع) حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، قَالَ : أَخْبَرَنَا سُفْيَانُ ، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، عَنْ عَلْقَمَةَ ، قَالَ : أُتِيَ عَبْدُ اللَّهِ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ ، ثُمَّ مَاتَ عَنْهَا ، وَلَمْ يَفْرِضْ لَهَا صَدَاقًا ، وَلَمْ يَكُنْ دَخَلَ بِهَا , قَالَ : فَاخْتَلَفُوا إِلَيْهِ ، فَقَالَ : أَرَى لَهَا مِثْلَ صَدَاقِ نِسَائِهَا ، وَلَهَا الْمِيرَاثُ ، وَعَلَيْهَا الْعِدَّةُ , فَشَهِدَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " قَضَى فِي بِرْوَعَ ابْنَةِ وَاشِقٍ بِمِثْلِ مَا قَضَى " .
Alqamah narrates that a case was presented to Sayyiduna Abdullah in which a woman had married a man, and shortly after, he passed away. He had neither fixed her dowry nor had they been alone together. What is the ruling regarding this? Various companions presented different opinions. Sayyiduna Ibn Mas’ud said: My opinion is that this woman should receive a dowry similar to that of women like her, she will also receive a share in inheritance, and she will observe the waiting period (‘iddah). Upon hearing this decision, Sayyiduna Ma’qil bin Sinan testified that the Prophet (peace and blessings be upon him) had given exactly such a verdict regarding Barwa’ bint Washiq.
