(حديث مرفوع) حَدَّثَنَا حَجَّاجٌ ، قَالَ ابْنُ جُرَيْجٍ : أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ ، عَنْ هِشَامِ بْنِ يَحْيَى أَخْبَرَهُ ، أَنَّ عِكْرِمَةَ بْنَ سَلَمَةَ بْنِ رَبِيعَةَ أَخْبَرَهُ ، أَنَّ أَخَوَيْنِ مِنْ بَنِي الْمُغِيرَةِ أَعْتَقَ أَحَدُهُمَا أَنْ لَا يَغْرِزَ خَشَبًا فِي جِدَارِهِ ، فَلَقِيَا مُجَمِّعَ بْنَ يَزِيدَ الْأَنْصَارِيَّ وَرِجَالًا كَثِيرًا ، فَقَالُوا : نَشْهَدُ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لَا يَمْنَعْ جَارٌ جَارَهُ أَنْ يَغْرِزَ خَشَبًا فِي جِدَارِهِ " ، فَقَالَ الْحَالِفُ : أَيْ أَخِي ، قَدْ عَلِمْتُ أَنَّكَ مَقْضِيٌّ لَكَ عَلَيَّ ، وَقَدْ حَلَفْتُ ، فَاجْعَلْ أُسْطُوَانًا دُونَ جِدَارِي ، فَفَعَلَ الْآخَرُ ، فَغَرَزَ فِي الْأُسْطُوَانِ خَشَبَةً , فَقَالَ لِي عَمْرٌو : فَأَنَا نَظَرْتُ إِلَى ذَلِكَ .
Ikrimah bin Salamah says that two brothers from Banu Mughira came to meet Sayyiduna Majma’ bin Yazid. (One of them swore that if the other placed a beam on his wall, his slave would be set free.) Sayyiduna Majma’ said, “I bear witness that the Prophet (peace and blessings be upon him) said: ‘No neighbor should place a beam on his neighbor’s wall.’” Upon hearing this, the one who had sworn said, “Brother, now I know that the decision of the Shariah is in your favor, and I have also taken an oath. Now, if you place a beam on my wall, I will have to set my slave free. You may build a pillar behind my wall.” So the other did exactly that and placed his beam on that pillar.
