(حديث مرفوع) حَدَّثَنَا
مُحَمَّدُ بْنُ جَعْفَرٍ ، قَالَ : حَدَّثَنَا
شُعْبَةُ ، عَنْ
مَنْصُورٍ ، قَالَ : سَمِعْتُ
مُجَاهِدًا يُحَدِّثُ , عَنْ
أُسَيْدِ بْنِ ظُهَيْرٍ ، قَالَ : كَانَ أَحَدُنَا إِذَا اسْتَغْنَى عَنْ أَرْضِهِ ، أَوْ افْتَقَرَ إِلَيْهَا ، أَعْطَاهَا بِالنِّصْفِ وَالثُّلُثِ وَالرُّبُعِ ، وَيَشْتَرِطُ ثَلَاثَ جَدَاوِلَ وَالْقُصَارَةَ وَمَا سَقَى الرَّبِيعُ ، وَكُنَّا نَعْمَلُ فِيهَا عَمَلًا شَدِيدًا ، وَنُصِيبُ مِنْهَا مَنْفَعَةً ، فَأَتَانَا
رَافِعُ بْنُ خَدِيجٍ ، فَقَالَ : نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ أَمْرٍ كَانَ لَكُمْ نَافِعًا وَطَاعَةُ اللَّهِ وَطَاعَةُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَيْرٌ لَكُمْ ، نَهَاكُمْ عَنِ الْحَقْلِ ، وَقَالَ : " مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَمْنَحْهَا أَخَاهُ ، أَوْ لِيَدَعْهَا " ، وَنَهَانَا عَنِ الْمُزَابَنَةِ . وَالْمُزَابَنَةُ : الرَّجُلُ يَكُونُ لَهُ الْمَالُ الْعَظِيمُ مِنَ النَّخْلِ ، فَيَجِيءُ الرَّجُلُ ، فَيَأْخُذُهَا بِكَذَا وَكَذَا وَسْقًا مِنْ تَمْرٍ .
Usaid bin Zuhair says that when any one of us became independent of his land, he would give it to others for a third, a quarter, or a half share, and would set three conditions: the produce near the canals, the husk, and the vegetables. At that time, life was very difficult and hard; people used to work with iron, etc., but they would get profit in this work. One day, Sayyiduna Rafi’ bin Khadij (may Allah be pleased with him) came to us and said: The Prophet (peace and blessings be upon him) has forbidden you from something that could have been beneficial for you, but obedience to Allah and His Messenger is even more beneficial for you. The Prophet (peace and blessings be upon him) forbade leasing land and said: Whoever has land should cultivate it himself, and if he cannot do it himself, he should allow his brother to do it, and he forbade muzabanah, which means that a person has a lot of dates and another man comes and says: I have taken this produce from you in exchange for such-and-such a measure of dates.
