Hadith 15289

(حديث مرفوع) حَدَّثَنَا عَفَّانُ , حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ , حَدَّثَنَا مَعْمَرٌ , عَنِ الزُّهْرِيِّ ، عَنْ أَبِي سَلَمَةَ ، عَنْ جَابِرٍ , قَالَ : " قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ , فَإِذَا وَقَعَتِ الْحُدُودُ , وَصُرِّفَتِ الطُّرُقُ فَلَا شُفْعَةَ " .
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) established the right of pre-emption in every property that has not been divided. When boundaries are marked and the paths are separated, then the right of pre-emption no longer remains.
