Hadith 14403

(حديث مرفوع) حَدَّثَنَا إِسْمَاعِيلُ ، عَنْ ابْنِ جُرَيْجٍ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الشُّفْعَةُ فِي كُلِّ شِرْكٍ رَبْعَةٍ ، أَوْ حَائِطٍ ، لَا يَصْلُحُ لَهُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ ، فَإِنْ بَاعَ ، فَهُوَ أَحَقُّ بِهِ حَتَّى يُؤْذِنَهُ " .
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: There is the right of pre-emption in every joint property and garden, and it is not permissible to sell it without informing one's partner. If he sells it, then his partner has more right to it, until he gives him permission.
