(حديث مرفوع) حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنْ سُفْيَانَ ، حَدَّثَنِي حُمَيْدٌ . ح وَرَوْحٌ ، قَالَ : حَدَّثَنَا سُفْيَانُ الثَّوْرِيُّ ، عَنْ حُمَيْدِ بْنِ قَيْسٍ الْأَعْرَجِ ، عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، " أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْطَى أُمَّهُ حَدِيقَةً مِنْ نَخْلٍ حَيَاتَهَا ، فَمَاتَتْ ، فَجَاءَ إِخْوَتُهُ ، فَقَالُوا : نَحْنُ فِيهِ شَرْعٌ سَوَاءٌ ، فَأَبَى ، فَاخْتَصَمُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَسَمَهَا بَيْنَهُمْ مِيرَاثًا " .
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that an Ansari man gave a date orchard to his mother until the Day of Judgment. When his mother passed away, his brothers came and said, "We all have an equal share in it," but he refused. The people brought this case to the service of the Prophet (peace and blessings of Allah be upon him), so the Prophet (peace and blessings of Allah be upon him) divided it among them as inheritance.
