Hadith 1222

(حديث مرفوع) حَدَّثَنَا يَزِيدُ ، أَخْبَرَنَا زَكَرِيَّا ، عَنْ أَبِي إِسْحَاقَ ، عَنِ الْحَارِثِ ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : إِنَّكُمْ تَقْرَءُونَ : مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ سورة النساء آية 12 ، وَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " قَضَى بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ ، وَإِنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ ، يَرِثُ الرَّجُلُ أَخَاهُ لِأَبِيهِ ، وَأُمِّهِ دُونَ أَخِيهِ لِأَبِيهِ " .
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) decided that "the payment of the deceased's debt will be made before the execution and implementation of the will," whereas in the Qur'an, the mention of the will comes before the debt, and that "uterine brothers will be heirs but consanguine brothers will not be heirs." A person's full brother will be his heir, but a brother sharing only the father will not be an heir. Benefit: A brother sharing only the mother is called 'ukhiyafi' and a brother sharing only the father is called 'ilati'.
