Hadith 1091

(حديث مرفوع) حَدَّثَنَا وَكِيعٌ ، حَدَّثَنَا سُفْيَانُ ، عَنْ أَبِي إِسْحَاقَ ، عَنِ الْحَارِثِ ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ ، وَأَنْتُمْ تَقْرَءُونَ : مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ سورة النساء آية 12 ، وَإِنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ " .
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) decreed that the payment of the deceased’s debt will be carried out before the execution and implementation of the will, whereas in the Qur’an, the mention of the will comes before the debt. And that maternal brothers will be heirs, but paternal brothers will not be heirs. Benefit: A brother sharing the same mother is called "akhyafi," and a brother sharing the same father is called "alati."
