Hadith 34
حَدَّثَنَا الأَسْوَدُ بْنُ عَامِرٍ، عَنْ شُعْبَةَ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ : " مَنِ ابْتَاعَ نَخْلا قَدْ أُبِّرَتْ "، سَأَلْتُهُ، فَقَالَ : لُقِّحَتْ، فَثَمَرُهُ لِلْبَائِعِ، إِلا أَنَّهُ يَشْتَرِطُ الْمُبْتَاعُ " .
It is narrated from Sayyiduna Abdullah bin Umar, may Allah be pleased with them both, that the Noble Prophet, peace and blessings be upon him, said: "Whoever sells a date-palm tree after it has been pollinated, then its (current year's) fruit belongs to the seller, except if the buyer stipulates a condition."
