Hadith 238
عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، قَالَتْ : جَاءَتْ بَرِيرَةُ، فَقَالَتْ : إِنِّي كَاتَبَنِي أَهْلِي عَلَى تِسْعِ أَوَاقٍ، فِي كُلِّ عَامٍ أُوقِيَّةٌ فَأَعِينِينِي، فَقَالَتْ : إِنْ أَحَبَّ أَهْلُكِ أَنْ أَعُدَّهَا لَهُمْ عِدَّةً وَاحِدَةً وَيَكُونُ وَلاؤُكِ لِي فَعَلْتُ، فَذَهَبَتْ إِلَى أَهْلِهَا فَأَبَوْا ذَلِكَ عَلَيْهَا، فَجَاءَتْ إِلَى عَائِشَةَ وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عِنْدَهَا، فَقَالَتْ : إِنِّي عَرَضْتُ عَلَيْهِمْ فَأَبَوْا إِلا أَنْ يَكُونَ الْوَلاءُ لَهُمْ، فَسَمِعَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِذَلِكَ فَسَأَلَ عَائِشَةَ، فَأَخْبَرَتْهُ، فَقَالَ : " خُذِيهَا فَأَعْتِقِيهَا وَاشْتَرِطِي لَهُمُ الْوَلاءَ، فَإِنَّ الْوَلاءَ لِمَنْ أَعْتَقَ "، فَفَعَلَتْ ذَلِكَ عَائِشَةُ، ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَشِيَّةً فِي النَّاسِ، فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ، ثُمَّ قَالَ : " أَمَّا بَعْدُ، فَمَا بَالُ رِجَالٍ مِنْكُمْ يَشتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ، مَا كَانَ مِنْ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ، وَإِنْ كَانَ مِائَةَ شَرْطٍ، كِتَابُ اللَّهِ أَحَقُّ، وَشَرْطُ اللَّهِ أَوْثَقُ، فَمَا بَالُ أَحَدُكُمْ يَقُولُ : أَعْتِقْ فُلانًا وَلِيَ الْوَلاءُ، إِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ " .
Lady Aisha (may Allah be pleased with her) narrates that Barirah came and said: Indeed, my masters have written a contract of emancipation with me for seven uqiyahs, one uqiyah (forty dirhams) to be paid each year, so please help me. She (Aisha) said: If your masters are pleased that I pay them the entire amount at once, I will do so, but your "wala" (right of allegiance) will be mine. She went to her masters, but they refused this, so she came back to Aisha (may Allah be pleased with her) while the Messenger of Allah (peace and blessings be upon him) was with her, and said: Indeed, I offered it to them, but they refused, except that the "wala" would be theirs. When the Messenger of Allah (peace and blessings be upon him) heard this, he asked Aisha (may Allah be pleased with her), and she informed him of the whole matter. He (peace and blessings be upon him) said: "Then buy her and set her free, and stipulate the condition of 'wala' for them, for indeed 'wala' is for the one who sets free." So Aisha (may Allah be pleased with her) did so. Then the Messenger of Allah (peace and blessings be upon him) stood among the people in the latter part of the day, praised and glorified Allah, and then said: "Amma ba'd! What is the matter with some men among you who impose conditions that are not in the Book of Allah? Any condition that is not in the Book of Allah is invalid, even if there are a hundred such conditions. The decision of Allah is more rightful and the condition of Allah is stronger. So what is the matter with one of you who says he has set someone free but the 'wala' is his? 'Wala' is only for the one who sets free."
