Hadith 226
عَنِ ابْنِ عَوْنٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ عُمَرَ أَصَابَ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ : يَا رَسُولَ اللَّهِ، إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ، وَاللَّهِ مَا أَصَبْتُ مَالا قَطُّ هُوَ أَنْفَسُ عِنْدِي مِنْهُ، فَمَا تَأْمُرُنِي ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنْ شِئْتَ تَصَدَّقْتَ بِهَا وَحَبَسْتَ أَصْلَهَا "، فَجَعَلَهَا عُمَرُ صَدَقَةً لا يُبَاعُ أَصْلُهَا وَلا يُورَثُ وَلا يُوهَبُ، وَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ، وَالْقُرْبَى، وَفِي سَبِيلِ اللَّهِ، وَفِي الرِّقَابِ، وَابْنِ السَّبِيلِ، وَالضَّيْفِ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ وَيُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ . فَذَكَرْتُهُ لِمُحَمَّدٍ، فَلَمَّا بَلَغَ غَيْرَ مُتَمَوِّلٍ فِيهِ، قَالَ : غَيْرَ مُتأَثِّلٍ فِيهِ مَالا . فَأَخْبَرَنِي إِنْسَانٌ أَنَّهُ قَرَأَ تِلْكَ الرُّقْعَةَ فَإِذَا فِيهَا : غَيْرَ مُتأَثِّلٍ مَالا .
Sayyiduna Ibn Umar (may Allah be pleased with them both) narrates that indeed Umar (may Allah be pleased with him) acquired land in Khaybar, so he came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah (peace and blessings be upon him)! Indeed, I have acquired land in Khaybar. By Allah! I have never acquired any wealth that is more precious to me than this. What do you advise me? The Prophet (peace and blessings be upon him) said: "If you wish, give it as charity and keep its original (property) withheld." So Umar (may Allah be pleased with him) gave it as charity (in such a way that) its original could neither be sold, nor gifted, nor inherited. He gave it as charity for the poor, relatives, in the way of Allah, for freeing slaves, for travelers and guests. There is no sin upon the one who manages it, to eat from it in a good manner and to feed a friend, but he should not make it his own wealth. I mentioned this hadith to Muhammad, and when I reached here, "he should not make it his own wealth," he said that there should be no one asking for wealth in it. So a man informed me that indeed he had read that note, in which it was written that there should be no one asking for wealth in it.
