Hadith 179
أنا مُحَمَّدُ بْنُ أَبِي حَفْصَةَ، وَمَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَنَّ امْرَأَةً جَاءَتْ عُمَرَ بْنَ الْخَطَّابِ تَطْلُبُ مِيرَاثَهَا مِنْ زَوْجِهَا، فَقَالَ عُمَرُ : إِنَّمَا الدِّيَةُ لِلْعَاقِلَةِ وَلا أَعْلَمُ لَكِ شَيْئًا، وَقَالَ مَعْمَرٌ : مَا أَرَى الدِّيَةَ إِلا لِلْعَصَبَةِ لأَنَّهُمْ يَعْقِلُونَ، فَنَشَدْتُ النَّاسَ، فَقَالَ : هَلْ أَحَدٌ عِنْدَهُ مِنْ هَذَا عِلْمٌ ؟ فَقَالَ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلابِيّ : " إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَيَّ أَنْ أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضَّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا "، فَوَرَّثَهَا عُمَرُ .
Saeed bin Musayyib (may Allah have mercy on him) narrates that indeed a woman came to Umar bin Khattab (may Allah be pleased with him), demanding her inheritance from her husband’s (blood money), so Umar (may Allah be pleased with him) said: “Blood money is only for the ‘Asabah (male agnates), and I do not know of anything for you.” And Mu’ammar said that he understood that blood money is only for the ‘Asabah, because they are the ones who pay it. Then he consulted the people and said: “Does anyone have any knowledge about this?” So Dahhak bin Sufyan al-Kilabi (may Allah be pleased with him) said that indeed the Messenger of Allah (peace and blessings be upon him) wrote to me that I should make the wife of Ashyam Dhibabi an heir from her husband’s blood money, so Umar (may Allah be pleased with him) made her an heir.
