Hadith 176
عَنْ سُفْيَانَ، عَنْ أَبِي إِسْحَاقَ، عَنِ الْحَارِثِ، عَنْ عَلِيٍّ، قَالَ : " قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ، وَأَنْتُمْ تَقْرَءُونَ : مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ سورة النساء آية 12، وَإِنَّ أَعْيَانَ بَنِي الأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلاتِ، يَعْنِي الإِخْوَةَ لِلأَبِ، وَالأُمِّ دُونَ الإِخْوَةِ لِلأَبِ " .
It is narrated from Sayyiduna Ali (may Allah be pleased with him), he said that the Messenger of Allah (peace and blessings be upon him) paid off the debt before the bequest, although you recite, ﴿مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ﴾ (An-Nisa: 12) "After any bequest he may have made or debt (has been paid)." And indeed, full brothers inherit from one another, not half-brothers. That is, brothers from both the father and mother, not just from the father.
