Hadith 157

نا هِشَامُ بْنُ سَعْدٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ : قِيلَ : يَا رَسُولَ اللَّهِ، كَيْفَ تَرَى فِي حَرِيسَةِ الْجَبَلِ ؟ قَالَ : " فِيهَا غَرَامَةٌ مِثلُهَا، وَجَلَدَاتُ نَكَالٍ، وَلَيْسَ فِي شَيْءٍ مِنَ الْمَاشِيَةِ قَطْعٌ إِلا مَا أَوَاهُ الْمُرَاحُ، فَبَلَغَ ثَمَنَ الْمِجَنِّ، فَفِيهِ الْقَطْعُ، وَلَيْسَ فِي شَيْءٍ مِنَ الثَّمَرِ إِلا فِيمَا أَوَاهُ الْجَرِينُ فَمَا أُخِذَ مِنَ الْجَرِينِ فَبَلَغَ ثَمَنَ الْمِجَنِّ فَفِيهِ الْقَطْعُ " .
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) narrates that it was said: O Messenger of Allah (peace and blessings be upon him)! What is your opinion about the enclosures of goats in the field? The Messenger of Allah (peace and blessings be upon him) said: "For them, there is compensation like them, and there are lashes as punishment, and the hand is not cut off for anything among the animals except for that which the enclosure provides space for, and it reaches the value of a shield, then the hand is cut off for it. And for anything among the fruits, (the hand is not cut off) except for that which the threshing floor (the place where fruits are gathered) provides space for. Whoever takes from the threshing floor and it reaches the value of a shield, then the hand is to be cut off for it."
