عَنْ شُعْبَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عُبَيْدِ بْنِ نَضْلَةَ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، أَنَّ امْرَأَتَيْنِ كَانَتَا تَحْتَ رَجُلٍ مِنْ بَنِي هُذَيْلٍ، فَرَمَتْ إِحْدَاهُمَا الأُخْرَى بِعَمُودِ فُسْطَاطٍ فَأُسْقِطَتْ، فَاخْتَصَمُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالُوا : كَيْفَ نَدِي مَنْ لا صَاحَ وَلا اسْتَهَلَّ وَلا شَرِبَ وَلا أَكَلَ ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَسَجْعٌ كَسَجْعِ الأَعْرَابِ، فَقَضَى فِيهِ بِغُرَّةٍ، وَجَعَلَهُ عَلَى عَاقِلَةِ الْمَرْأَةِ " .
Sayyiduna Mughira bin Shu’bah (may Allah be pleased with him) narrates that indeed two women who were under one man from Banu Huzail (as wives), one of them struck the other with a tent pole, causing her pregnancy to miscarry. They brought the dispute to the Prophet Muhammad (peace be upon him) and said: How can we pay blood money for one who neither cried nor screamed, neither drank nor ate? The Prophet (peace be upon him) said: “Is this rhymed speech like the rhymed speech of the Bedouins?” Then the Prophet (peace be upon him) ruled for the freeing of a slave, and made it incumbent upon the woman’s ‘asaba (male relatives).
