باب طَلاَقِ الثَّلاَثِ:
Chapter: Threefold Divorce
Hadith 1472
حدثنا إِسْحَاقَ بْنُ إِبْرَاهِيمَ ، وَمُحَمَّدُ بْنُ رَافِعٍ ، وَاللَّفْظُ لِابْنِ رَافِعٍ ، قَالَ إِسْحَاقَ : أَخْبَرَنا ، وَقَالَ ابْنُ رَافِعٍ : حدثنا عَبْدُ الرَّزَّاقِ ، أَخْبَرَنا مَعْمَرٌ ، عَنِ ابْنِ طَاوُسٍ ، عَنْ أَبِيهِ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : كَانَ الطَّلَاقُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَأَبِي بَكْرٍ ، وَسَنَتَيْنِ مِنْ خِلَافَةِ عُمَرَ ، طَلَاقُ الثَّلَاثِ : وَاحِدَةً ، فقَالَ عُمَرُ بْنُ الْخَطَّابِ : " إِنَّ النَّاسَ قَدِ اسْتَعْجَلُوا فِي أَمْرٍ قَدْ كَانَتْ لَهُمْ فِيهِ أَنَاةٌ ، فَلَوْ أَمْضَيْنَاهُ عَلَيْهِمْ ، فَأَمْضَاهُ عَلَيْهِمْ " .
Ibn 'Abbas (RA) reported that the (pronouncement) of three divorces during the lifetime of Allah's Messenger (ﷺ) and that of Abu Bakr (RA) and two years of the caliphate of Umar (RA) (was treated) as one. But Umar bin Khattab (RA) said: Verily the people have begun to hasten in the matter in which they are required to observe respite. So if we had imposed this upon them, and he imposed it upon them.
Hadith 1472
حدثنا إِسْحَاقَ بْنُ إِبْرَاهِيمَ ، أَخْبَرَنا رَوْحُ بْنُ عُبَادَةَ ، أَخْبَرَنا ابْنُ جُرَيْجٍ . ح وحدثنا ابْنُ رَافِعٍ ، وَاللَّفْظُ لَهُ ، حدثنا عَبْدُ الرَّزَّاقِ ، أَخْبَرَنا ابْنُ جُرَيْجٍ ، أَخْبَرَنِي ابْنُ طَاوُسٍ ، عَنْ أَبِيهِ ، أَنَّ أَبَا الصَّهْبَاءِ ، قَالَ لِابْنِ عَبَّاسٍ : " أَتَعْلَمُ أَنَّمَا كَانَتِ الثَّلَاثُ تُجْعَلُ وَاحِدَةً عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَأَبِي بَكْرٍ وَثَلَاثًا مِنْ إِمَارَةِ عُمَرَ فقَالَ ابْنُ عَبَّاسٍ : نَعَمْ " .
Abu Sahba' said toIbn 'Abbas (RA) : Do you know that three (divorces) were treated as one during the lifetime of Allah's Apostle (ﷺ) , and that of Abu Bakr, and during three (years) of the caliphate of Umar (RA) ? Ibn Abbas (RA) said: Yes.
Hadith 1472
وحدثنا إِسْحَاقَ بْنُ إِبْرَاهِيمَ ، أَخْبَرَنا سُلَيْمَانُ بْنُ حَرْبٍ ، عَنْ حَمَّادِ بْنِ زَيْدٍ ، عَنْ أَيُّوبَ السَّخْتِيَانِيِّ ، عَنْ إِبْرَاهِيمَ بْنِ مَيْسَرَةَ ، عَنْ طَاوُسٍ : أَنَّ أَبَا الصَّهْبَاءِ ، قَالَ لِابْنِ عَبَّاسٍ : هَاتِ مِنْ هَنَاتِكَ " أَلَمْ يَكُنِ الطَّلَاقُ الثَّلَاثُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَأَبِي بَكْرٍ وَاحِدَةً ، فقَالَ : قَدْ كَانَ ذَلِكَ ، فَلَمَّا كَانَ فِي عَهْدِ عُمَرَ تَتَايَعَ النَّاسُ فِي الطَّلَاقِ ، فَأَجَازَهُ عَلَيْهِمْ " .
Abu al-Sahba' said to Ibn 'Abbas (RA) : Enlighten us with your information whether the three divorces (pronounced at one and the same time) were not treated as one during the lifetime of Allah's Messenger (ﷺ) and Abu Bakr. He said: It was in fact so, but when during the caliphate of 'Umar (RA) people began to pronounce divorce frequently, he allowed them to do so (to treat pronouncements of three divorces in a single breath as one).
