Hadith 253
حَدَّثَنَا أَبُو كُرَيْبٍ مُحَمَّدُ بْنُ الْعَلَاءِ ، حَدَّثَنَا ابْنُ بِشْرٍ ، عَنْ مِسْعَرٍ ، عَنْ الْمِقْدَامِ بْنِ شُرَيْحٍ ، عَنْ أَبِيهِ ، قَالَ : سَأَلْتُ عَائِشَةَ ، قُلْتُ : " بِأَيِّ شَيْءٍ كَانَ يَبْدَأُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، إِذَا دَخَلَ بَيْتَهُ ؟ قَالَتْ : بِالسِّوَاكِ " .
Miqdam bin Shuraih narrated it from his father who said: I asked A'isha what Allah's Apostle (ﷺ) did first when he entered his house, and she replied: He used tooth-stick (first of all).

From this it is understood that the Prophet (sallallahu alayhi wa sallam) would also make a practice of using the miswak outside of the times of prayer.

Some jurists have stipulated certain conditions which are not established by any evidence, such as the miswak being one handspan in length, or not using the miswak without water, and so on.

8. Commentary:
➊ This chapter can also be seen as a continuation of the previous chapter, in that whenever the Prophet (sallallahu alayhi wa sallam) would enter his house, he would use the miswak. It is evident that he was often in a state of fasting, therefore a fasting person may use the miswak at any time.
➋ “At every time” here refers to customary generality (‘urfi istighraq), not literal. Otherwise, many times are logically and legally excepted, such as: during prayer and recitation, while eating, while speaking, and during relieving oneself, etc. And Allah knows best.
