Hadith 1725

وحَدَّثَنِي أَبُو الطَّاهِرِ ، وَيُونُسُ بْنُ عَبْدِ الْأَعْلَى ، قَالَا : حَدَّثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ ، قَالَ : أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ ، عَنْ بَكْرِ بْنِ سَوَادَةَ ، عَنْ أَبِي سَالِمٍ الْجَيْشَانِيِّ ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ : " مَنْ آوَى ضَالَّةً فَهُوَ ضَالٌّ مَا لَمْ يُعَرِّفْهَا " .
Zaid bin Khalid al-Juhani reported Allah's Messenger (ﷺ) as sayin.: He who found a stray article is himself led astray if he does not advertise it.

Hadith Commentary: Benefits and Issues: From this hadith, it is understood that it is not permissible to pick up a lost item in order to take ownership of it. And if in this context "dallah" refers to a lost camel, then since it is not permissible in any case to take ownership of it, if there is no danger, it cannot be seized at all. And if there is a danger, then it may only be seized for the purpose of protection and public announcement. Therefore, to not continuously announce it is to deviate from the correct path.
