The Book of Divorce
باب تَحْرِيمِ طَلاَقِ الْحَائِضِ بِغَيْرِ رِضَاهَا وَأَنَّهُ لَوْ خَالَفَ وَقَعَ الطَّلاَقُ وَيُؤْمَرُ بِرَجْعَتِهَا:
Chapter: The prohibition of divorcing a menstruating woman without her consent; If a man breaks this rule, it still counts as a divorce, and he should be ordered to take her back
Hadith 1471
This hadith is listed as number 3668 in Maktaba Shamila
وحَدَّثَنِيهِ يَحْيَى بْنُ حَبِيبٍ ، حدثنا خَالِدُ بْنُ الْحَارِثِ . ح وحَدَّثَنِيهِ عَبْدُ الرَّحْمَنِ بْنُ بِشْرٍ ، حدثنا بَهْزٌ ، قَالَا : حدثنا شُعْبَةُ ، بِهَذَا الْإِسْنَادِ ، غَيْرَ أَنَّ فِي حَدِيثِهِمَا لِيَرْجِعْهَا وَفِي حَدِيثِهِمَا ، قَالَ : قُلْتُ لَهُ : أَتَحْتَسِبُ بِهَا ؟ قَالَ : فَمَهْ .
This hadith has been narrated on the authority of Shu'bah with the same chain of transmitters but with a slight variation in wording.
