Hadith 1439

حدثنا أَحْمَدُ بْنُ عَبْدِ اللَّهِ بْنِ يُونُسَ ، حدثنا زُهَيْرٌ ، أَخْبَرَنا أَبُو الزُّبَيْرِ ، عَنْ جَابِرٍ ، أَنَّ رَجُلًا أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فقَالَ : إِنَّ لِي جَارِيَةً هِيَ خَادِمُنَا وَسَانِيَتُنَا ، وَأَنَا أَطُوفُ عَلَيْهَا ، وَأَنَا أَكْرَهُ أَنْ تَحْمِلَ ، فقَالَ : " اعْزِلْ عَنْهَا إِنْ شِئْتَ ، فَإِنَّهُ سَيَأْتِيهَا مَا قُدِّرَ لَهَا " ، فَلَبِثَ الرَّجُلُ ثُمَّ أَتَاهُ ، فقَالَ : إِنَّ الْجَارِيَةَ قَدْ حَبِلَتْ ، فقَالَ : " قَدْ أَخْبَرْتُكَ أَنَّهُ سَيَأْتِيهَا مَا قُدِّرَ لَهَا " .
Jabir (RA) reported that a man came to Allah's Messenger (ﷺ) and said: I have a slave-girl who is our servant and she carries water for us and I have intercourse with her, but I do not want her to conceive. He said: Practise 'azl, if you so like, but what is decreed for her will come to her. The person stayed back (for some time) and then came and said: The girl has become pregnant, whereupon he said: I told you what was decreed for her would come to her.

حدثنا سَعِيدُ بْنُ عَمْرٍو الْأَشْعَثِيُّ ، حدثنا سُفْيَانُ بْنُ عُيَيْنَةَ ، عَنْ سَعِيدِ بْنِ حَسَّانَ ، عَنْ عُرْوَةَ بْنِ عِيَاضٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ : سَأَلَ رَجُلٌ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فقَالَ : إِنَّ عَنْدِي جَارِيَةً لِي ، وَأَنَا أَعْزِلُ عَنْهَا ، فقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّ ذَلِكَ لَنْ يَمْنَعَ شَيْئًا أَرَادَهُ اللَّهُ " ، قَالَ : فَجَاءَ الرَّجُلُ ، فقَالَ : يَا رَسُولَ اللَّهِ ، إِنَّ الْجَارِيَةَ الَّتِي كُنْتُ ذَكَرْتُهَا لَكَ حَمَلَتْ ، فقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَنَا عَبْدُ اللَّهِ وَرَسُولُهُ " .
Jabir bin 'Abdullah (RA) reported that a person asked Allah's Apostle (ﷺ) saying: I have a slave-girl and I practise 'azl with her, whereupon Allah's Messenger (ﷺ) said: This cannot prevent that which Allah has decreed. The person then came (after some time) and said: Messenger of Allah, the slave-girl about whom I talked to you has conceived, whereupon Allah's Messenger (ﷺ) said: I am the servant of Allah and His Messenger.

وحدثنا حَجَّاجُ بْنُ الشَّاعِرِ ، حدثنا أَبُو أَحْمَدَ الزُّبَيْرِيُّ ، حدثنا سَعِيدُ بْنُ حَسَّانَ قَاصُّ أَهْلِ مَكَّةَ ، أَخْبَرَنِي عُرْوَةُ بْنُ عِيَاضِ بْنِ عَدِيِّ بْنِ الْخِيَارِ النَّوْفَلِيُّ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ : جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمَعْنَى حَدِيثِ سُفْيَانَ .
Jabir bin 'Abdullah (RA) reported: A person came to Allah's Apostle (ﷺ) (the rest of the hadith is the same).

Explanation:

1:
‘Azl is that when ejaculation is near during intercourse, a man withdraws his sexual organ from the private part and ejaculates outside so that the woman does not become pregnant.

2:
In this hadith, it is only stated that the belief of the Jews is incorrect, because even with ‘azl, if Allah intends the creation of a soul from that man and woman, its creation will certainly occur. As it happened that a Companion performed ‘azl with a slave woman, yet she became pregnant. Therefore, this is not “minor infanticide” (maw’udat saghrah).

Commentary:
(1)
Despite planning, destiny prevails; however, this does not prevent the use of planning.
A person should make his effort and leave the result to Allah.

(2)
‘Azl means that a man, while engaged in intercourse with his wife or slave woman, when he feels that ejaculation is near, withdraws so that ejaculation occurs outside and pregnancy does not occur.
This was, in effect, the method of family planning in that era.

(3)
‘Azl with a slave woman is permissible because her becoming pregnant would hinder her service to the owner, and the main purpose of keeping a slave woman is household work and service to the owner. However, performing ‘azl with a free woman (wife) is conditional upon her permission.

Benefit:
From this hadith, it is understood that 'azl (withdrawal) is permissible, that is, Islamic law has allowed it (meaning to have intercourse with one's wife and to ejaculate outside).
This hadith also establishes the authority of tacit (taqreeri) hadith, that is, an action that was done during the time of the Prophet sallallahu alayhi wa sallam, and was reported to him, is considered a tacit hadith. If there had been any ambiguity in a tacit hadith, the Messenger of Allah sallallahu alayhi wa sallam would have corrected it at that time, whereas in this case he remained silent about it.

Benefit:
From this hadith it is established that no matter how much one practices coitus interruptus (azl), when Allah has decreed, the very drop (of semen) in which Allah has placed offspring will be utilized, and granting offspring is not within anyone’s power, nor is taking offspring. This matter is solely in the hands of Allah Ta’ala.
