Hadith Commentary:
Imam Bukhari rahimahullah has established the chapter heading regarding the prohibition of temporary marriage (nikah mut‘ah), whereas in this hadith its permissibility is mentioned. In reality, it is stated in Sahih Muslim that Hazrat Salamah bin Akwa‘ radi Allahu anhu says that then we were prohibited from it (Sahih Muslim, Kitab al-Nikah, Hadith: 3418 (1405)).
Although in one narration it is mentioned:
Hazrat Umar radi Allahu anhu, during his caliphate, prohibited it.
Hazrat Umar radi Allahu anhu did not prohibit it based on his own ijtihad (independent reasoning), but rather in view of the prohibitive command of the Messenger of Allah sallallahu alayhi wa sallam, as is mentioned in the hadith:
When Hazrat Umar radi Allahu anhu became caliph, he ascended the pulpit and delivered a sermon, saying that the Messenger of Allah sallallahu alayhi wa sallam had permitted temporary marriage (nikah mut‘ah) for three days, then prohibited it.
(Sunan Ibn Majah, Kitab al-Nikah, Hadith: 1963)
In another narration, it is mentioned that Hazrat Umar radi Allahu anhu sat upon the pulpit, praised and glorified Allah, and said:
What is the matter with people that they contract temporary marriage (nikah mut‘ah) while the Messenger of Allah sallallahu alayhi wa sallam had prohibited it?
