Hadith 1364

وحدثنا إِسْحَاقَ بْنُ إِبْرَاهِيمَ ، وَعَبْدُ بْنُ حميد ، جميعا عَنِ الْعَقَدِيِّ ، قَالَ عبدَ : أَخْبَرَنَا عَبْدُ الْمَلِكِ بْنُ عَمْرٍو ، حدثنا عَبْدُ اللَّهِ بْنُ جَعْفَرٍ ، عَنْ إِسْمَاعِيل بْنِ مُحَمَّدٍ ، عَنْ عَامِرِ بْنِ سَعْدٍ : أَنَّ سَعْدًا رَكِبَ إِلَى قَصْرِهِ بِالْعَقِيقِ ، فَوَجَدَ عَبْدًا يَقْطَعُ شَجَرًا أَوْ يَخْبِطُهُ فَسَلَبَهُ ، فَلَمَّا رَجَعَ سَعْدٌ جَاءَهُ أَهْلُ الْعَبْدِ ، فَكَلَّمُوهُ أَنْ يَرُدَّ عَلَى غُلَامِهِمْ أَوْ عَلَيْهِمْ مَا أَخَذَ مِنْ غُلَامِهِمْ ، فقَالَ : مَعَاذَ اللَّهِ أَنْ أَرُدَّ شَيْئًا نَفَّلَنِيهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَأَبَى أَنْ يَرُدَّ عَلَيْهِمْ .
'Amir bin Sa'd reported that Sa'd rode to his castle in al-'Aqiq and found a slave cutting down the trees, or beating off their leaves, so he stripped him off his belongings. When Sa'd returned, there came to him the masters of the slave and negotiated with him asking him to return to their slave or to them what he had taken from their slave, whereupon he said: God forbid that I should return anything which Allah's Messenger (ﷺ) has given me as spoil, and refused to return anything to them.

Benefits and Issues:
This hadith establishes that if a person violates the sanctity and greatness of Madinah by cutting down its trees or hunting there, then his equipment and belongings will be confiscated. However, according to the majority of the imams, although he has committed an unlawful act, there is no penalty or ransom (fidya) upon him.
But the practice of the noble Companions (radi Allahu anhum ajma'in) was in accordance with this hadith.
Even though those who came later have neglected this.
