وحَدَّثَنَا
إِسْحَاق بْنُ إِبْرَاهِيمَ ، أَخْبَرَنَا
مُحَمَّدُ بْنُ بَكْرٍ ، أَخْبَرَنَا
ابْنُ جُرَيْجٍ ، أَخْبَرَنِي
عَطَاءٌ ، قَالَ : كَانَ
ابْنُ عَبَّاسٍ ، يَقُولُ : " لَا يَطُوفُ بِالْبَيْتِ حَاجٌّ ، وَلَا غَيْرُ حَاجٍّ ، إِلَّا حَلَّ " ، قُلْتُ لِعَطَاءٍ : مِنْ أَيْنَ يَقُولُ ذَلِكَ ؟ ، قَالَ : مِنْ قَوْلِ اللَّهِ تَعَالَى ثُمَّ مَحِلُّهَا إِلَى الْبَيْتِ الْعَتِيقِ سورة الحج آية 33 ، قَالَ : قُلْتُ : فَإِنَّ ذَلِكَ بَعْدَ الْمُعَرَّفِ ، فَقَالَ : كَانَ ابْنُ عَبَّاسٍ يَقُولُ : هُوَ بَعْدَ الْمُعَرَّفِ وَقَبْلَهُ ، " وَكَانَ يَأْخُذُ ذَلِكَ مِنْ أَمْرِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، حِينَ أَمَرَهُمْ أَنْ يَحِلُّوا فِي حَجَّةِ الْوَدَاعِ " .
Ata' said: Ibn 'Abbas (RA) used to say that a pilgrim or non-pilgrim (one performing 'Umrah) who circumambulates the House is free from the responsibility of Ihram. I (Ibn Juraij, one of the narrators) said to 'Ata': On what authority does he ( Ibn Abbas (RA) ) say this? He said: On the authority uf Allah's words: "Then their place of sacrifice is the Ancient House" (al-Qur'an, xxii. 33). I said: It concerns the time after staying at 'Arafat, whereupon he said: Ibn 'Abbas (RA) had stated (that the place of sacrifice is the Ancient House); it may be after staying at 'Arafat or before (staying there). And he ( Ibn Abbas (RA) ) made this deduction I from the command of Allah's Apostle (ﷺ) when he had ordered to put off Ihram on the occasion of the Farewell Pilgrimage.

Hadith Commentary: Benefits and Issues: In these ahadith, the well-known opinion of Abdullah ibn Abbas radi Allahu anhu is mentioned, that according to him, if someone has assumed the ihram for Hajj Ifrad or Hajj Qiran but has not brought the sacrificial animal (hady) with him from the miqat or from outside the Haram, then if he performs the Tawaf al-Qudum, he will have to convert it into an ‘umrah and come out of the state of ihram.
After performing the tawaf of the House of Allah, only that person can remain in the state of ihram who has the sacrificial animal with him. In other words, he will annul the ihram of Hajj, convert it into an ‘umrah, perform the ‘umrah, and come out of ihram. Then later, he will assume ihram for Hajj from Makkah al-Mukarramah.
Imam Ahmad rahimahullah, Imam Ishaq rahimahullah, Hafiz Ibn Hazm rahimahullah, Hafiz Ibn Taymiyyah rahimahullah, Hafiz Ibn Qayyim rahimahullah, and others have accepted the opinion of Ibn Abbas radi Allahu anhu. For details, see (Zad al-Ma‘ad, vol. 2, pp. 166–206).
