Hadith 1244

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى ، وَابْنُ بَشَّارٍ ، قَالَ ابْنُ الْمُثَنَّى : حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، قَالَ : حَدَّثَنَا شُعْبَةُ ، عَنْ قَتَادَةَ ، قَالَ : سَمِعْتُ أَبَا حَسَّانَ الْأَعْرَجَ ، قَالَ : قَالَ رَجُلٌ مِنْ بَنِي الْهُجَيْمِ لِابْنِ عَبَّاسٍ : مَا هَذَا الْفُتْيَا الَّتِي قَدْ تَشَغَّفَتْ أَوْ تَشَغَّبَتْ بِالنَّاسِ ، أَنَّ مَنْ طَافَ بِالْبَيْتِ فَقَدْ حَلَّ ؟ ، فَقَالَ : " سُنَّةُ نَبِيِّكُمْ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَإِنْ رَغِمْتُمْ " .
Abu Hassan al-A'raj reported that a person from Bani Hujaim said to Ibn 'Abbas (RA) : What is this religious verdict of yours which has engaged the attention of the people or which has become a matter of dispute among them that he who circumambulated the House can be free from Ihram? Thereupon he said: That is the Sunnah of your Apostle (ﷺ), even though you may not approve of it.

وحَدَّثَنِي أَحْمَدُ بْنُ سَعِيدٍ الدَّارِمِيُّ ، حَدَّثَنَا أَحْمَدُ بْنُ إِسْحَاق ، حَدَّثَنَا هَمَّامُ بْنُ يَحْيَى ، عَنْ قَتَادَةَ ، عَنْ أَبِي حَسَّانَ ، قَالَ : قِيلَ لِابْنِ عَبَّاسٍ : " إِنَّ هَذَا الْأَمْرَ قَدْ تَفَشَّغَ بِالنَّاسِ ، مَنْ طَافَ بِالْبَيْتِ فَقَدْ حَلَّ الطَّوَافُ عُمْرَةٌ " ، فَقَالَ : " سُنَّةُ نَبِيِّكُمْ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَإِنْ رَغَمْتُمْ " .
Abu Hassaan reported: It was said to Ibn 'Abbas (RA) that this affair had engaged the attention of the people that he who circumambulates the House was permitted to circumambulate for 'Umrah (even though he was in a state of Ihram for Hajj), whereupon he said: That is the Sunnah of your Apostle (ﷺ) , even though you may not approve of it.

The position of Ibn Abbas radi Allahu anhu is that merely performing the circumambulation (tawaf) of the House of Allah is sufficient for a person to become lawful (halal), and for this, performing the sa‘i between Safa and Marwah and shaving or shortening the hair (halq or taqsir) is not necessary. As is found in Sahih Muslim, Ibn Abbas radi Allahu anhu said:
By merely performing tawaf, a person becomes halal, whether he intends Hajj or ‘Umrah.
(Sahih Muslim, al-Hajj, Hadith: 3020(1245))

In fact, a man said to Ibn Abbas radi Allahu anhu:
What is this legal verdict you have spread among the people, that whoever performs tawaf, the restrictions of ihram are lifted from him? He replied: This is the Sunnah of your Prophet sallallahu alayhi wa sallam, even if you find it objectionable.
(Sahih Muslim, al-Hajj, Hadith: 3018 (1244))

In any case, this position of Ibn Abbas radi Allahu anhu is contrary to the majority of the scholars.
A few people have followed this, for example, Imam Ishaq ibn Rahwayh is among those who hold this view.
