باب تَحْرِيمِ الصَّيْدِ الْمَأُكُولِ الْبَرِّيِّ ، وَمَا أَصْلُهُ ذٰلِكَ عَلَي الْمُحْرِمِ بِحَجُ أَوُ عمْرَةٍ أَوْ بِهِمَاChapter: The prohibition of hunting game for the one who has entered Ihram for Hajj or for Umrah or for both
حَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنِ ابْنِ جُرَيْجٍ ، أَخْبَرَنِي مُحَمَّدُ بْنُ الْمُنْكَدِرِ ، عَنْ مُعَاذِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عُثْمَانَ التَّيْمِيِّ ، عَنْ أَبِيهِ ، قَالَ : كُنَّا مَعَ طَلْحَةَ بْنِ عُبَيْدِ اللَّهِ وَنَحْنُ حُرُمٌ ، فَأُهْدِيَ لَهُ طَيْرٌ وَطَلْحَةُ رَاقِدٌ ، فَمِنَّا مَنْ أَكَلَ وَمِنَّا مَنْ تَوَرَّعَ ، فَلَمَّا اسْتَيْقَظَ طَلْحَةُ وَفَّقَ مَنْ أَكَلَهُ ، وَقَالَ : " أَكَلْنَاهُ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " .
Abdul Rahman bin 'Uthman Taimi reported on the authority of his father; While we were with Talha bin 'Ubaidullah (RA) and were in the state of Ihram we were presented a (cooked) bird. Talha was sleeping. Some of us ate it and some of us refrained from (eating) it. When Talha awoke he agreed with him who ate it, and said: We ate it along with the Messenger of Allah (ﷺ) .

Hadith Commentary: Benefits and Issues: Since this game animal was hunted by a person of the lawful (halal) group for himself, and later a portion of it was presented as a gift to Hazrat Talhah radi Allahu anhu, for this reason he supported the position of those who permitted eating it.
