Musannaf Ibn Abi Shaybah

Ibrahim (may Allah be pleased with him) says that if a detachment sets out for jihad and whatever (spoils) come into their hands, the leader may, if he wishes, give them an extra share, and if he wishes, a fifth share.

Hazrat Hasan (may Allah be pleased with him) says that if a detachment sets out for jihad without the permission of the Imam and they obtain spoils, then the Imam will take one-fifth from it, and the rest will belong to them.

Hazrat Yahya bin Saeed (may Allah be pleased with him) narrates that I asked Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him): I participated in jihad in the region of Darb. When we departed, some expeditions were sent after us. They were told that you will receive the spoils of war except for the khums. What do you say about this? Hazrat Saeed bin Al-Musayyib replied that people used to give nafl (voluntary charity) only from the khums.

It is narrated from Hazrat Hasan (may Allah be pleased with him) that the Holy Prophet (peace and blessings be upon him) said: Any army that attacks without the permission of the leader is treacherous and deceitful.

Hazrat Mansur (may Allah be pleased with him) says that I asked Ibrahim (may Allah be pleased with him) whether an Imam sends a detachment and they obtain spoils of war? He replied: If the Imam wishes, he may give them an extra share, and if he wishes, he may take out the khums (one-fifth).

Hazrat Hasan (may Allah be pleased with him) says that if an army marches with the permission of the Imam, then one-fifth (khums) will be taken out from their spoils, and the rest will be given to them. And if they march without the Imam's permission, then they are like a (regular) army.
