Hadith 34990
٣٤٩٩٠ - حدثنا عبد الرحيم بن سليمان عن حجاج عن عطية عن ابن عباس في قوله: ﴿إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ وَيَسْعَوْنَ فِي الْأَرْضِ فَسَادًا أَنْ يُقَتَّلُوا أَوْ ⦗٢٧٢⦘ يُصَلَّبُوا أَوْ تُقَطَّعَ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلَافٍ﴾ حتى ختم الآية. فقال: إذا حارب الرجل وقتل وأخذ المال قطعت يده ورجله من خلاف وصلب، وإذا قتل ولم يأخذ المال قتل، وإذا أخذ المال ولم يقتل قطعت يده ورجله من خلاف، وإذا لم يقتل ولم يأخذ المال نفي (١).
Hazrat Atiyyah (may Allah have mercy on him) narrates that Hazrat Ibn Abbas (may Allah be pleased with them both) recited the saying of Allah, the Lord of Might:
Verse: Translation: The only recompense of those who wage war against Allah and His Messenger ﷺ and strive to spread corruption in the land is that they be killed, or crucified, or have their hands and feet cut off from opposite sides.
He (may Allah be pleased with him) recited the complete verse and said: When a person fights, kills, and also takes wealth, then one of his hands and one of his feet will be cut off from opposite sides and he will be crucified. And when someone kills but does not take wealth, he will be killed. And when he takes wealth but does not kill, then one of his hands and one of his feet will be cut off from opposite sides. And when he neither kills nor takes wealth, he will be exiled from the land.
Hadith 34991
٣٤٩٩١ - حدثنا وكيع عن عمران بن (حدير) (١) عن أبي مجلز في هذه الآية: ﴿إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ﴾ قال: إذا قَتَل وأخذ المال قُتل، وإذا أخذ المال وأخاف السبيل صلب، وإذا قتل ولم يعد ذلك (قتل، وإذا أخذ المال لم يعد ذلك) (٢) قطع، وإذا أفسد نفي.
Hazrat Imran bin Hadeer (may Allah have mercy on him) narrates that Hazrat Abu Majliz (may Allah have mercy on him) regarding this verse: Translation: The only recompense of those who wage war against Allah and His Messenger ﷺ... He (may Allah have mercy on him) said: When a person kills and also takes wealth, then he will be killed. And when he seizes wealth and makes the road dangerous, then he will be crucified. And when he kills and does not repeat this act, then he will be killed. And when he seizes wealth and does not kill, then his hands and feet will be cut off. And when he spreads corruption, then he will be exiled from the land.
Hadith 34992
٣٤٩٩٢ - حدثنا عبد اللَّه بن إدريس عن أبيه عن حماد عن إبراهيم: ﴿إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ﴾ قال: إذا خرج (فأخاف) (١) السبيل وأخذ المال قطعت يده ورجله من خلاف، وإذا أخاف السبيل ولم يأخذ المال نفي، (وإذا) (٢) قَتَلَ قُتِلْ، وإذا أخاف السبيل وأخذ المال وقتل صلب.
Hazrat Hammad (may Allah have mercy on him) says that Ibrahim (may Allah have mercy on him) said regarding this verse: {إنَّمَا جَزَائُ الَّذِینَ یُحَارِبُونَ اللَّہَ وَرَسُولَہُ } When he goes out and makes the road dangerous and seizes wealth, then one of his hands and one of his legs from the opposite side will be cut off. And when he makes the road dangerous but does not seize wealth, then he will be exiled from the country. And when he also commits murder, then he will also be killed. And when he makes the road dangerous, seizes wealth, and commits murder, then he will be crucified.
Hadith 34993
٣٤٩٩٣ - حدثنا محمد بن بكر عن ابن جريج قال: حدثت عن سعيد بن جبير قال: من حارب فهو محارب قال سعيد: (فإن) (١) أصاب دمًا قتل، وإن (أصاب) (٢) ⦗٢٧٣⦘ دمًا ومالًا صلب، فإن الصلب هو أشد، وإذا أصاب مالًا ولم يصب دمًا قطعت يده ورجله لقوله: ﴿أَوْ تُقَطَّعَ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلَافٍ﴾ فإن (تاب) (٣) فتوبته فيما بينه وبين اللَّه ويقام عليه الحد.
Hazrat Ibn Jurayj (may Allah have mercy on him) says that it has been narrated to me from Hazrat Saeed bin Jubair (may Allah have mercy on him) that he (may Allah have mercy on him) said: Whoever fights is a highway robber (muharib). Then he (may Allah be pleased with him) said: If he sheds blood, he will be killed, and if he sheds blood and also seizes wealth, he will be crucified, for indeed crucifixion is more severe. And when he seizes wealth but does not shed blood, then one of his hands and one of his legs will be cut off, due to the saying of Allah, the Lord of Honor: Translation: Or their hands and their feet will be cut off from opposite sides. So if he repents, then his repentance will be between him and Allah, and the prescribed punishment will still be carried out upon him.
Hadith 34994
٣٤٩٩٤ - حدثنا زيد بن حباب عن أبي هلال عن قتادة عن مورق العجلي قال: إذا أُخذ المحارب فرفع إلى الإمام، فإن كان أخذ المال ولم يَقتُل [قطع ولم يُقتَل، وإن (كان) (١) أخذ المال وقتل (قُتل) (٢)] (٣) وصلب، وإن كان لم يأخذ المال ولم يقتل (٤) (لم يقطع) (٥)، (٦) وإن كان لم يأخذ المال ولم يقتل و (شاق) (٧) المسلمين نفي.
Hazrat Qatadah (may Allah have mercy on him) narrates that Hazrat Murriq Ajli (may Allah have mercy on him) said: When a combatant is captured, he will be brought before the leader. If he has seized wealth but has not committed murder, then his hand and foot will be cut off, but he will not be killed. If he has seized wealth and also committed murder, then he will be killed and crucified. If he has neither seized wealth nor committed murder, then neither his hand nor his foot will be cut off. And if he has neither seized wealth nor committed murder, but has only harassed the Muslims, then he will be expelled from the country.
