Hadith 34980
٣٤٩٨٠ - حدثنا حفص عن حجاج عن الحكم قال: كان أهل العلم (يقولون) (١): إذا آمن المحارب لم يؤخذ بشيء كان أصابه في حال حربه إلا أن يكون شيئا أصابه قبل ذلك.
Hazrat Hakam (may Allah have mercy on him) says that the scholars used to say: When a combatant is granted amnesty, the wealth he acquired during the state of war will not be taken from him. However, the wealth he acquired before the war will be taken from him.
Hadith 34981
٣٤٩٨١ - حدثنا عبدة بن سليمان عن هشام عن أبيه في الرجل يصيب الحدود، ثم يجيء تائبًا، قال: تقام عليه الحدود.
Hazrat Hisham (may Allah have mercy on him) narrates that his father, Hazrat Urwah (may Allah have mercy on him), said regarding the person who becomes liable for the prescribed punishments (hudood) and then repents and comes back. He (may Allah have mercy on him) said: The prescribed punishments will be carried out on such a person.
Hadith 34982
٣٤٩٨٢ - حدثنا عبد الرحيم بن سليمان عن عبيدة عن إبراهيم في الرجل يجني الجناية فيلحق بالعدو فيصيبهم أمان، قال: يؤمنون إلا أن يعرف شيء بعينه فيؤخذ منهم، فيرد على أصحابه، وأما هو فيؤخذ بما كان جنى قبل أن يلحق بهم.
Hazrat Ubaidah (may Allah have mercy on him) says that Ibrahim (may Allah have mercy on him) stated: If a person commits a crime and joins the enemies, and then those people are granted amnesty. He (may Allah have mercy on him) said: They will be granted amnesty except for any item that is recognized as being in their possession; that item will be taken from them and returned to its owners. And the item will be taken which he had acquired through crime before joining the enemies.
Hadith 34983
٣٤٩٨٣ - حدثنا جرير عن مغيرة عن حماد عن إبراهيم في رجل أصاب حدًا، ثم خرج محاربًا، ثم طلب أمانا فأمن، قال: يقام عليه الحد الذي كان أصابه.
Hazrat Hammad (may Allah have mercy on him) says that Ibrahim (may Allah have mercy on him) was asked about a person: who is subjected to the prescribed punishment, then fights and escapes, and then seeks protection and is granted protection? He (may Allah have mercy on him) replied: The prescribed punishment will be carried out on him because of the act he committed.
Hadith 34984
٣٤٩٨٤ - حدثنا جرير عن مغيرة عن حماد عن إبراهيم في الرجل إذا قطع الطريق وأغار ثم رجع تائبا أقيم عليه الحد، وتوبته فيما بينه وبين ربه.
Hazrat Hammad (may Allah have mercy on him) says that Hazrat Ibrahim (may Allah have mercy on him), regarding the person who commits robbery and plunder and then repents and returns, stated: The prescribed punishment (hadd) will be established upon him, and his repentance will be between him and his Lord.
Hadith 34985
٣٤٩٨٥ - حدثنا أبو أسامة قال: ثنا جرير بن حازم قال: حدثني قيس بن سعد أن عطاء كان يقول: لو أن رجلًا من المسلمين قتل رجلًا ثم كفر فلحق بالمشركين فكان فيهم، ثم رجع تائبا قبلت توبته من شركه، وأقيم عليه القصاص، ولو أنه ⦗٢٧٠⦘ لحق بالمشركين ولم يقتل فكفر ثم قاتل المسلمين فقتل منهم ثم جاء تائبا قبل منه، ولم يكن عليه شيء.
Hazrat Qais bin Sa’d (may Allah have mercy on him) narrates that Hazrat Ata (may Allah have mercy on him) used to say: If any man from among the Muslims kills another man and then adopts disbelief and joins the polytheists and stays among them, then later he repents and returns, his repentance from polytheism will be accepted, and the punishment of retribution (qisas) will be enforced upon him. And if someone joins the polytheists in such a state that he has not committed murder, but only adopted disbelief, then fought against the Muslims and martyred some Muslims, then he repents and returns, his repentance will be accepted and nothing will be obligatory upon him.
