Hadith 30964
٣٠٩٦٤ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن أبيه عن حماد عن إبراهيم قال: ﴿إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ﴾ [المائدة: ٣٣]، قال: إذا خرج وأخاف (السبيل) (١) وأخذ المال (قطعت يده ورجله من خلاف، وإذا أخاف السبيل ولم يأخذ المال نفي، وإذا قَتل قُتل، وإذا أخاف السبيل وأخذ المال) (٢) وقَتل صُلب.
Hazrat Hammad says that Ibrahim explained the verse: Surely the recompense of those who wage war against Allah and His Messenger (peace be upon him)... He said: When they go out and put a traveler in fear and seize property, then one hand and one foot of theirs, from opposite sides, will be cut off. And when they put a traveler in fear but do not seize property, then they will be exiled. And when they also commit murder, then they will be killed as well. And when they put a traveler in fear, seize property, and also commit murder, then they will be crucified.
Hadith 30965
٣٠٩٦٥ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: حدثت عن سعيد بن جبير قال: من حارب فهو محارب (قال) (١) (٢) سعيد: فإن أصاب دمًا قتل، وإن أصاب دما ومالًا صلب، فإن الصلب هو أشد، وإذا أصاب مالًا ولم يصب دمًا قطعت يده ورجله لقول اللَّه ﷻ: ﴿أَوْ تُقَطَّعَ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلَافٍ﴾ فإن تاب فتوبته بينه وبين اللَّه ويقام عليه الحد.
Hazrat Ibn Jurayj states that it has been narrated to me that Hazrat Saeed bin Jubair said: Whoever fights is a warrior. Hazrat Saeed said: So if he sheds blood, he will be killed, and if he sheds blood and seizes wealth, he will be crucified. Indeed, crucifixion is more severe, and when he seizes wealth but does not shed blood, then his hand and one of his legs will be cut off. This is because of the saying of Allah, the Majestic and Glorious. Translation: Or their hands and their feet be cut off from opposite sides. So if he repents, then his repentance will be between him and Allah, and the prescribed punishment will still be carried out upon him.
Hadith 30966
٣٠٩٦٦ - حدثنا أبو بكر قال: حدثنا عبد الرحيم بن سليمان عن حجاج عن عطية عن ابن عباس في قوله: ﴿إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ وَيَسْعَوْنَ فِي الْأَرْضِ فَسَادًا أَنْ يُقَتَّلُوا أَوْ يُصَلَّبُوا أَوْ تُقَطَّعَ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلَافٍ﴾ حتى ختم الآية فقال: إذا حارب الرجل فقتل وأخذ المال قطعت يده ورجله من خلاف وصلب، وإذا قتل ولم يأخذ المال قتل، وإذا أخذ المال ولم يقتل قطعت يده ورجله ⦗٥٤⦘ من خلاف، وإذا لم يقتل ولم يأخذ المال نفي (١).
Hazrat Atiyyah narrates that the commentary of the verse is reported from Hazrat Ibn Abbas (may Allah be pleased with them): "The only recompense of those who wage war against Allah and His Messenger (peace be upon him) and strive to spread corruption in the land is that they be killed, or crucified, or have their hands and feet cut off from opposite sides..." until he completed the verse. He said: When a person wages war, kills, and seizes wealth, then one of his hands and one foot from the opposite side should be cut off and he should be crucified. And when he kills but does not seize wealth, then he should also be killed. And when he seizes wealth but does not kill, then one of his hands and one foot from the opposite side should be cut off. And when he neither kills nor seizes wealth, then he should be exiled.
Hadith 30967
٣٠٩٦٧ - حدثنا أبو بكر قال: حدثنا وكيع عن عمران بن حدير عن أبي مجلز في هذه الآية: ﴿إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ﴾ وقال: إذا قتل وأخذ المال قتل، وإذا أخذ المال وأخاف السبيل صلب، وإذا قتل (و) (١) لم يعد (ذلك) (٢) قتل، وإذا أخذ المال لم يعد ذلك قطع، وإذا أفسد نفي.
Hazrat Imran bin Hadeer narrates that Hazrat Abu Majliz, regarding this verse: "The only recompense of those who wage war against Allah and His Messenger (etc.)," said: When he kills and seizes wealth, he should be killed; and when he seizes wealth and puts the traveler in fear, he should be crucified; and when he kills but does not seize wealth, he should be killed; and when he seizes wealth but does not kill, his hand should be cut off; and when he spreads corruption, he should be exiled.
