Musannaf Ibn Abi Shaybah

Hazrat Shu’bah narrates that it is reported from Hazrat Hakam regarding the person who says to another man: "You committed adultery while you were a polytheist." He said: The prescribed punishment (hadd) will not be imposed on him.

Hazrat Waki' states that Hazrat Sufyan said: When someone says, "You committed adultery while you were a polytheist," then the prescribed punishment (hadd) will be carried out on him.

Hazrat Amr narrates that it is reported from Hasan Basri regarding that disbeliever who commits adultery and the prescribed punishment is carried out upon him, then he embraces Islam. After that, if someone accuses him and says: "Indeed, I meant that adultery which he committed while he was a disbeliever," he (Hasan Basri) said: The prescribed punishment will be carried out upon the one who accuses him.

Hazrat Ibn Abi Dhi'b says that I asked Hazrat Zuhri about a woman who had committed adultery while she was a Jew, Christian, or fire-worshipper, and then she embraced Islam. So if someone accuses her (of adultery), what is the ruling? Hazrat Ibn Shihab replied: The prescribed punishment (hadd) will not be carried out on the one who accuses this woman, but he will be given a severe exemplary punishment.
