Musannaf Ibn Abi Shaybah

Hazrat Mutarrif narrates that Hazrat Aamir said: When he fled towards the Haram, indeed he attained safety. Thus, if he committed any punishable act within the Haram, then the prescribed punishment will be carried out upon him within the Haram.

Hazrat Ata says that Hazrat Walid intended to enforce the hadd punishment on a man in the Haram, so Hazrat Ubaid bin Umair said to him: Do not enforce the hadd punishment on him unless he committed the punishable act within the Haram itself.

Hazrat Hisham states that Hasan Basri and Hazrat Ata said: When someone becomes liable for a hadd punishment outside the Haram and then seeks refuge in the Haram, he will be taken out of the Haram until the hadd punishment is carried out on him.

Hazrat Khaseef narrates that Hazrat Mujahid said: When a person becomes liable for hadd (punishment) outside the Haram and then enters the Haram, he will be taken out of the Haram and then the hadd will be carried out on him. And when he becomes liable for hadd within the Haram, then the hadd will be carried out on him within the Haram.

Hazrat Khaseef narrates that it is reported from Hazrat Mujahid that a man killed another man and then entered the Haram. He said: He will be seized and taken out of the Haram, then the prescribed punishment will be carried out upon him. He said: He will be killed.

It is narrated from Hazrat Saeed and Hazrat Ata regarding a person who commits murder and then enters the Haram, they said: The people of Makkah should neither buy nor sell with him, nor give him water, nor feed him, nor give him shelter, nor marry him. Until he leaves, then he will be apprehended.

Hazrat Ata states that Hazrat Ibn Umar (may Allah be pleased with them both) and Hazrat Ibn Abbas (may Allah be pleased with them both) said: If we were to find the killer of our forefathers even in the Haram, we would not kill him.

Hazrat Sha’bah narrates that I asked Hazrat Hakam and Hazrat Hammad about the person who commits murder and then enters the Haram; what is the ruling regarding him? Hazrat Hammad said: He will be taken out and then the prescribed punishment will be carried out on him. Hazrat Hakam said: No buying or selling will be done with him, and he will not be given food.
