Musannaf Ibn Abi Shaybah

Hazrat Abdur Rahman bin Harmalah narrates that one of my neighbors gave divorce in a state of intoxication, then he instructed me to ask Hazrat Saeed bin Musayyib about it. He said: If he is in the right regarding this, then he should be given eighty lashes and separation should be made between him and his wife.

Hazrat Abdur Rahman bin Anbasah narrates that Hazrat Umar bin Abdul Aziz enforced her divorce and had her flogged.

Ayyub narrates that Hasan al-Basri and Ibn Sirin said: The divorce given by an intoxicated person is valid, and lashes will be administered on his back.

Hazrat Ja'far says that Maymun said: It is permissible to divorce her and he will be flogged.

Hazrat Awza'i says that Hazrat Zuhri stated: If someone frees (a slave) or divorces (his wife) in a state of intoxication, then his divorce will be valid and the prescribed punishment (hadd) will be enforced upon him.

Hazrat Sha'bi said: It is permissible to divorce her and her back will be caused pain.
