Musannaf Ibn Abi Shaybah

Hazrat Muammar narrates that Hazrat Zuhri said: A Muhajir man was accused during the time of Hazrat Umar bin Khattab, while his mother had passed away in the era of ignorance, so Hazrat Umar had him flogged due to the sanctity of a Muslim.

Hazrat Sha’bi was asked about a man who accused another man while his (the accuser’s) mother was a polytheist. He replied: What is your opinion if someone accuses Ash’ath—should he not be punished?

Hazrat Hammad narrates that it is reported from Ibrahim regarding the person who says to another: "You are not your father's son, and your mother was a slave woman, or she was a Jew or a Christian." He said: The prescribed punishment (hadd) will not be carried out on him.

Hazrat Abu Ghaniyah narrates that Hazrat Hakam said: When a man accuses another man while his (the accused's) mother was a Jew or a Christian, then the prescribed punishment (hadd) will not be carried out on him.
