Musannaf Ibn Abi Shaybah

Hazrat Abdullah bin Shaddad narrates that a woman was brought before Hazrat Umar who confessed to adultery four times. Upon this, he said: If you retract, we will not enforce the prescribed punishment upon you. The woman replied: Then two matters will be combined against me! I have committed an immoral act and the prescribed punishment has not been enforced upon me. So he enforced the prescribed punishment upon her.

Hazrat Sulayman bin Yasar narrates that Hazrat Abu Waqid was sent by Hazrat Umar to that woman, then he mentioned the hadith similar to the previous one.

Hazrat Jabir narrates that Hazrat Amir Sha'bi and Hazrat Ata, both of these personalities, stated: When someone confesses to the hadd punishment for adultery or the hadd punishment for theft, and then retracts the confession, the punishment will be waived.

Hazrat Qatadah states that Hazrat Yahya bin Ya’mur said: If someone confesses and then denies—that is, a person who admits to the prescribed punishment and then retracts.

Hazrat Humaid narrates that it is reported from Hasan Basri regarding the person who confesses before people and then denies it, he said: He will be apprehended because of this.

Hazrat Ash'ath narrates that it is reported from Hasan Basri regarding the person who confesses to a hadd punishment in the absence of the ruler, then denies it when he is presented (before the ruler). So he (Hasan Basri) did not hold the opinion that it should be made obligatory upon him.

Ismail narrates that Hazrat Ibn Shihab said: If a person confesses to theft or a hadd punishment several times and then denies it, nothing will be enforced upon him.
