Musannaf Ibn Abi Shaybah

Hazrat Abu Zubair states that Hazrat Jabir said: The punishment of cutting the hand will not be carried out on one who snatches something, one who loots, and one who commits treachery.

The aforementioned statement of Hazrat Jabir is narrated as marfu‘ with this chain from Hazrat Abu Zubair.

Hazrat Zuhri narrates that Marwan asked Hazrat Zaid bin Thabit about snatching something. He did not hold the opinion of cutting the hand in this matter.

Hazrat Hakam states that Hazrat Ali (may Allah be pleased with him) said: The punishment of cutting (the hand) will not be carried out on one who snatches something.

Hazrat Khallas narrates that Hazrat Ali (may Allah be pleased with him) did not cut the hand in the case of snatching something.

Hazrat Qatadah says that a slave snatched a collar. This matter was presented before Hazrat Adi bin Arta’ah, so he asked Hasan Basri about it. He replied: The punishment of cutting the hand will not be carried out on him. And he asked Hazrat Iyas bin Mu’awiyah about it; he differed, so Hazrat Adi wrote a letter to Hazrat Umar bin Abdul Aziz. Hazrat Umar wrote back: Indeed, the Arabs used to call this daytime theft; the punishment of cutting the hand will not be carried out on it, but you should cause pain to his back and keep him in long imprisonment.

Hazrat Hisham narrates that a case was brought before Hazrat Adi in which a man had snatched something. Hazrat Iyas said: The punishment of cutting the hand will be carried out on him, and Hasan Basri said: The punishment of cutting the hand will not be carried out on him. So Hazrat Adi wrote a letter to Hazrat Umar bin Abdul Aziz regarding this matter, and he replied: The punishment of cutting the hand will not be carried out on him because the Arabs used to call this "theft of the day."

Hasan Basri states that Muhammad said: There will be no punishment of cutting the hand for snatching.
