Musannaf Ibn Abi Shaybah

Hazrat Rafi' bin Khadij narrates that the Messenger of Allah, peace and blessings be upon him, said: The hand will not be cut off for stealing fruit or the buds of dates.

Hazrat Shu'aib narrates that Hazrat Abdullah bin Umar said: The hand will not be cut off in any case of theft of an animal until it reaches the place where the animal spends the night, and the hand will not be cut off in any theft of fruits until they reach the place where the dates are dried.

Hazrat Saeed narrates that Hazrat Ibn Umar (may Allah be pleased with them) said: The hand will not be cut for any kind of fruit except when it reaches the place where the dates become dry, and the hand will not be cut for any kind of animal except in the case when it reaches the place where they stay at night.

Hazrat Yahya bin Abi Kathir narrates that Hazrat Umar said: The hand will not be cut off for stealing bunches of dates, nor during a year of famine.

Hasan Basri narrates that a man who had stolen food was brought to the Noble Prophet (peace and blessings be upon him), but he did not have his hand cut off.

Hazrat Muammar narrates that Hazrat Zuhri said: There is no punishment of cutting the hand for the theft of fruit and grazing animals, but there will be a severe punishment and double compensation must be paid. And when that person reaches the place where the animals stay at night or the place where dates are dried, his hand will be cut off when he steals an amount equal to four dinars.
