Musannaf Ibn Abi Shaybah

Hazrat Qabeesah bin Dhu’ayb narrates that a man had intercourse with his slave woman while she had a husband, so Hazrat Umar punished that man with one hundred lashes.

Hazrat Zaid bin Aslam narrates that a man was brought to Hazrat Umar who had intercourse with his slave-girl even though he had already married her to someone else, so Hazrat Umar gave him a punishment less than the prescribed legal limit.

Hazrat Muammar narrates that Hazrat Zuhri said: When a man has intercourse with his slave woman while she also has a husband, then that person will be given one hundred lashes, whether he is married or unmarried. If she becomes pregnant, the child will be attributed to her husband.
