Musannaf Ibn Abi Shaybah

Hazrat Muhammad bin Zubair states that Hazrat Mak'hool said: When a man has performed li'an and the wife refuses to perform li'an, then she will be stoned to death.

Hazrat Ash'ath narrates that Hasan Basri said: This woman will be imprisoned.

Hazrat Juwaybir narrates that it is reported from Hazrat Dahhak regarding the person who accused his wife, but his wife refused to perform li'an; he said: She will be given one hundred lashes and will be stoned to death.

Isa al-Khayyat narrates that Hazrat Shabi said: If a person is subject to li'an and he refuses to take the oath, then the hadd will be established upon that person. And Isa said: I heard others besides Imam Shabi say: Both of them will be compelled to perform li'an and they will be imprisoned until they both perform li'an.

30350 - Isa said: I heard (other than) (1) al-Sha'bi say: They are compelled to perform li'an and are detained until they perform li'an.

Hazrat Sha'bi, Hazrat Mujahid, and Hazrat Ata said: When the matter of li'an is concluded, then the child will be joined to him.

30352 - (And Jabir) (1) from al-Sha'bi.

30353 - From Sufyan, from Layth, from Mujahid and Ata, they said: If the prescribed punishment is averted in li'an, the child is attributed to him.
