Musannaf Ibn Abi Shaybah

Hazrat Burd narrates that Hazrat Makhool and Hazrat Zuhri said: The divorce given by a person intoxicated with drunkenness is valid, and his hand will be cut off if he commits theft.

Hazrat Hanzalah bin Abu Sufyan narrates that Hazrat Qasim was asked about a person who committed theft while intoxicated. He replied: If he was previously known for theft, then cut off his hand; otherwise, do not.

Hazrat Muhammad bin Salim states that it is narrated from Hazrat Sha'bi regarding a person in the initial stage of intoxication, that if he commits theft, his hand will be cut off. And he will be held accountable for all criminal offenses.

Hazrat Awza'i states that it is narrated from Hazrat Zuhri regarding a person intoxicated by wine that if he frees (a slave) or gives divorce, it will be accepted, and the prescribed punishment (hadd) will be established upon him.

Hazrat Muammar states that Hazrat Zuhri said: If he commits theft, his hand should be cut off, and if he commits murder, he should also be killed.

Hazrat Mughira narrates that Ibrahim said: If an intoxicated person speaks words that make him liable for hadd, then hadd will be established upon him.

Hazrat Hisham states that Hasan Basri and Hazrat Muhammad bin Sirin said: If he commits theft, his hand should be cut off.
