Musannaf Ibn Abi Shaybah

Hazrat Harith narrates that Hazrat Ali (may Allah be pleased with him) said: The prescribed punishment for nabidh is eighty lashes.

Hazrat Hassan bin Makharik narrates that news reached me that a man traveled with Hazrat Umar bin Khattab while he was fasting. When he broke his fast, he reached out his hand towards Hazrat Umar’s leather waterskin which was hanging and contained nabidh that had been well shaken by the camel. So the man drank from it and became intoxicated. Upon this, Hazrat Umar administered the prescribed punishment to him. The man said to him: Indeed, I drank from your waterskin? He replied to him: Indeed, we flogged you because you became intoxicated.

Hazrat Hisham states that it is narrated from Hasan Basri regarding one who becomes intoxicated by drinking nabidh, that he will be given eighty lashes.

Hazrat Ubaidah says that Ibrahim stated: In the case of drinking nabidh, the prescribed punishment will be enforced.

Hazrat Ubaidah says that Hazrat Abu Wa'il said: In this, the prescribed punishment will not be carried out.

Hazrat Abdullah bin Shaddad narrates that Hazrat Ibn Abbas (may Allah be pleased with them) said: In the case of intoxication from nabidh, the punishment is eighty lashes.

Hazrat Fudayl says that Hazrat Shaqiq Dhabbi said: There will be a limit in this, and the same lashes will be administered.

Hazrat Sha’bi narrates that Hazrat Ali (may Allah be pleased with him) gave people ripe grape syrup in small pitchers. As a result, one man became intoxicated. Hazrat Ali (may Allah be pleased with him) had him flogged eighty lashes. The narrator says that all the people testified before him that this person became intoxicated from the same syrup which you had given to the people. He said: Why did he drink so much of it that he became completely intoxicated?
