Musannaf Ibn Abi Shaybah

Hazrat Ma'ruf bin Suwaid narrates that some people used to steal slaves belonging to others from Africa. Hazrat Ali ibn Rabah said: The punishment of cutting the hand will not be enforced for this. Indeed, this incident is from the time of Hazrat Umar ibn Khattab. So he also did not hold the opinion of enforcing the punishment of cutting the hand upon them and said: These people are cunning and deceitful.

Hazrat Amr states that Hasan Basri said: Whoever steals a small child, his hand will be cut off.

Hazrat Ibn Abi Dhi'b narrates that it is reported from Hazrat Zuhri regarding the person who used to steal from children and non-Arabs. He said: His hand will be cut off.

Hazrat Ma'n or Hazrat Mu'ammar says that I asked Hazrat Ibn Shihab about the man who had stolen a non-Arab slave: What is the ruling for him? He replied: His hand will be cut off.

Hazrat Ibn Jurayj states that I have been informed that Hazrat Umar bin Khattab had a man's hand cut off in the case of a boy whom he had stolen.
