Musannaf Ibn Abi Shaybah

Hazrat Qatadah narrates that it is reported from Hazrat Saeed bin Musayyib regarding a man who says to his wife, "I did not find you a virgin." Hazrat Saeed said: The prescribed punishment (hadd) will be applied and there is no li'an.

Hazrat Abdullah bin Hubaira narrates from a man whose name he mentioned, that a question was asked to Hazrat Zaid bin Thabit and Hazrat Ibn Umar (may Allah be pleased with them both) regarding a man who said to his wife: "I did not find you a virgin." Both of them said: If he separates from her, he will be punished with lashes as a hadd, and she will remain his wife. And if he does not separate, then there will be li'an between them and separation will be established between the two.

Hazrat Ibn Abi Dhi'b states that Hazrat Zuhri said: When a man has had intercourse with a woman and then says, "I did not find her to be a virgin," the prescribed punishment (hadd) will be carried out on him and there will be no li'an (mutual cursing). This is because he did not say: "Indeed, I saw you committing adultery."
