Hadith 30018
٣٠٠١٨ - حدثنا أبو بكر قال: حدثنا شريك عن أبي حصين عن عبد اللَّه قال: (أتي عثمان بغلام قد سرق فقال: انظروا) (١) إلى مؤتزره هل أنبت (٢).
Hazrat Abdullah bin Masood narrates that a boy who had committed theft was brought to Hazrat Usman. He said: Look in his loincloth, has hair grown?
Hadith 30019
٣٠٠١٩ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان و (مسعر) (١) عن أبي حصين عن عبد اللَّه بن عبيد بن عمير عن (عثمان) (٢) بمثله (٣).
The aforementioned statement of Hazrat Usman is also narrated with this chain from Hazrat Abdullah bin Ubaid bin Umair.
Hadith 30020
٣٠٠٢٠ - حدثنا أبو بكر قال: حدثنا ابن علية عن إسماعيل بن أمية عن (محمد ⦗٣٥١⦘ ابن) (١) يحيى (بن حبان) (٢) قال: (ابتهر) (٣) غلام منا في (شعره) (٤) بامرأة (فرفع إلى عمر فشك فيه) (٥) (فنظر إليه) (٦) فلم يوجد أنبت فقال: لو وجدتك أنبت لجلدتك -أو لحددتك (٧).
Hazrat Muhammad bin Yahya bin Hayan narrates that one of our boys made a false claim against a woman. So this matter was presented before Hazrat Umar. He had some doubt about it, so he looked at him and felt that this boy was not yet mature. Upon this, he said: If I had seen you mature and strong, I would certainly have flogged you or certainly would have punished you.
Hadith 30021
٣٠٠٢١ - حدثنا أبو بكر قال: حدثنا مروان بن معاوية (عن حميد عن) (١) أنس أن أبا بكر أتي بغلام قد سرق، فلم يتبين احتلامه فشبره فنقص أنملة (فتركه) (٢) فلم يقطعه (٣).
Hazrat Anas (may Allah be pleased with him) narrates that a boy who had committed theft was brought to Hazrat Abu Bakr. Since it was not clear whether he had reached puberty, he was measured and found to be one finger-joint short. So, Hazrat Abu Bakr let him go and did not cut his hand.
Hadith 30022
٣٠٠٢٢ - [(حدثنا أبو بكر قال: حدثنا) (١) محمد بن بكر عن ابن جريج عن ابن أبي مليكة قال: أتي ابن الزبير بعبدٍ لعمر بن أبي ربيعة سرق، فأمر به فشبر وهو وصيف فبلغ ستة أشبار فقطعه] (٢) (٣).
Hazrat Ibn Abi Mulaika narrates that a slave of Umar bin Abi Rabee’ah, who had committed theft, was brought to Hazrat Abdullah bin Zubair. So he gave orders regarding him, and he was measured, and he was a young boy who had reached six spans. So he (Abdullah bin Zubair) had his hand cut off.
Hadith 30023
٣٠٠٢٣ - حدثنا أبو بكر قال: حدثنا زيد بن الحباب عن حماد بن سلمة عن قتادة عن خلاس عن علي قال: إذا بلغ الغلام (خمسة أشبار اقتص منه واقتص له) (١) (٢).
Hazrat Khallas narrates that Hazrat Ali (may Allah be pleased with him) said: When a boy reaches the height of five spans, retribution (qisas) will be taken from him and retribution will be taken for him.
Hadith 30024
٣٠٠٢٤ - حدثنا أبو بكر قال: حدثنا ابن مهدي عن همام عن قتادة أن عمر بن عبد العزيز والحسن كانا لا يقيمان على الغلام حدًا حتى يحتلم (١).
Hazrat Qatadah states that Hazrat Umar bin Abdul Aziz and Hasan Basri, both of these personalities, would not enforce the hadd punishment on a boy until he reached puberty.
Hadith 30025
٣٠٠٢٥ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج عن عطاء في الصبي يسرق، قال: لا قطع عليه حتى يحتلم (١).
Hazrat Ibn Jurayj states that it is narrated from Hazrat Ata regarding a child who commits theft; he said: The punishment of cutting the hand will not be enforced upon him until he reaches maturity. And Hazrat Amr bin Dinar said: It is not my opinion that the punishment of cutting the hand should be enforced upon him.
Hadith 30027
٣٠٠٢٧ - حدثنا أبو بكر قال: حدثنا الفضل بن دكين (عن حسن) (١) عن منصور عن إبراهيم قال: لا يقطع حتى يعقل -يعني يحتلم-.
Hazrat Mansur says that Ibrahim stated: His hand will not be cut off until he becomes sensible, that is, until he reaches maturity.
Hadith 30028
٣٠٠٢٨ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج عن سليمان بن موسى قال: لا حد، ولا قود على من لم يبلغ الحلم.
Hazrat Ibn Jurayj states that Hazrat Sulaiman bin Musa said: There will be neither hadd nor qisas upon one who has not reached puberty.
Hadith 30029
٣٠٠٢٩ - حدثنا أبو بكر قال: حدثنا عبدة بن سليمان عن يحيى عن سليمان بن يسار قال: أتي (عمر) (١) بغلام قد سرق فأمر به فشبر فوجد ستة أشبار إلا أنملة فتركه، فسمي الغلام نميلة (٢).
Hazrat Salman bin Yasar narrates that a boy who had committed theft was brought to Hazrat Umar. So, on his order, the boy was measured, and he found him to be six spans, but one finger-joint less. So he let him go, and thus the boy became known as Namila.
