Musannaf Ibn Abi Shaybah

Hazrat Sulaiman bin Musa narrates that Hazrat Usman said: His hand will not be cut off until he takes the goods out of the house.

Hazrat Amr bin Shu'aib narrates that Hazrat Ibn Umar (may Allah be pleased with them) said: The hand of that thief will not be cut off until he takes the goods out of the house.

Hazrat Musa bin Abu Al-Furat narrates that Hazrat Umar bin Abdul Aziz said: His hand will not be cut off until he takes the goods out of the house.

Hazrat Harith narrates that a man was brought to Hazrat Ali (may Allah be pleased with him) who had committed burglary and was caught in the act, but he did not cut off his hand.

Hazrat Asim narrates that Imam Shabi was asked about a person who committed theft and then wrapped the stolen goods in a bundle, but was caught before leaving the house. He replied: His hand will not be cut off.

Hazrat Zakariya narrates that Imam Shabi said: His hand will not be cut off until he takes the goods out of the house.

Hazrat Ibn Jurayj says that I asked Hazrat Ata: What is the ruling if a thief is caught gathering goods inside the house? He replied: His hand will not be cut until he takes the goods out. The Companions have said this, and Hazrat Amr bin Dinar said: I do not hold the opinion that his hand should be cut.

Hazrat Dawood narrates that Hazrat Abu Harb bin Abu Al-Aswad said: A thief broke into the house of some people. The watchmen saw him and caught him, and presented his case before Hazrat Abu Al-Aswad. He asked: Did you find anything with him? They said, no. He said: This poor and needy man intended to steal, so you acted hastily against him. Thus, he ordered that he be given twenty-five lashes.

Hazrat Humaid narrates that Hazrat Umar bin Abdul Aziz wrote a letter regarding a thief: His hand should not be cut off until he leaves the house with the stolen goods, perhaps he may be granted the ability to repent before leaving the house.

Hazrat Abdur Rahman bin Qasim narrates that Hazrat Aisha (may Allah be pleased with her) received the news that some people say: "If the thief has not taken the goods out, his hand should not be cut off." Upon this, she said: "Even if I find nothing but a knife, I will surely cut off his hand."
