Musannaf Ibn Abi Shaybah

Hazrat Mughira and Hazrat Hammad state that it is narrated from Ibrahim regarding two such slaves, one of whom gouged out the eye of his companion. He said: If the value of both is equal, then an eye will be gouged out in exchange for an eye, and if the value of one is greater than the other, then the one with the higher value will be returned to the one with the lower value.

29876 - From Hammad, from Ibrahim, regarding two slaves, one of whom gouges out the eye of his companion, he said: If their values are equal, then an eye for an eye; but if the value of one of them is greater than the (other) (1) (the greater) (2) compensates the lesser.

Hazrat Ibn Jurayj states that I asked Hazrat Ata regarding a slave who intentionally killed another slave, while the murdered slave was better than the killer. What will be the ruling in this case? He replied: The master of the murdered slave will only receive the killer slave; he will not get anything else besides this. And Hazrat Amr bin Dinar, in response to this, said: He will only receive the killer of his slave; if he wishes, he may kill him, and if he wishes, he may keep him as a slave.

29878 - And Amr ibn Dinar said: They have nothing except the killer of their slave; if they wish, they kill him, and if they wish, they enslave him.
