Hadith 29875
٢٩٨٧٥ - حدثنا أبو بكر قال: حدثنا جرير عن مغيرة عن إبراهيم.
Hazrat Mughira and Hazrat Hammad state that it is narrated from Ibrahim regarding two such slaves, one of whom gouged out the eye of his companion. He said: If the value of both is equal, then an eye will be gouged out in exchange for an eye, and if the value of one is greater than the other, then the one with the higher value will be returned to the one with the lower value.

٢٩٨٧٧ - حدثنا أبو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: قلت لعطاء: العبد يقتل العبد عمدًا، المقتول خير من القاتل؟ قال: ليس لسادة المقتول إلا قاتل عبدهم [ليس لهم غيره.
Hazrat Ibn Jurayj states that I asked Hazrat Ata regarding a slave who intentionally killed another slave, while the murdered slave was better than the killer. What will be the ruling in this case? He replied: The master of the murdered slave will only receive the killer slave; he will not get anything else besides this. And Hazrat Amr bin Dinar, in response to this, said: He will only receive the killer of his slave; if he wishes, he may kill him, and if he wishes, he may keep him as a slave.
