Regarding the Man Who Was Wounded or Killed
Hadith 29844
٢٩٨٤٤ - حدثنا أبو بكر قال: حدثنا أبو خالد الأحمر عن محمد بن إسحاق عن الحارث بن فضيل عن ابن أبي العوجاء عن أبي شريح الخزاعي قال: قال رسول اللَّه ﷺ: "من أصيب بدم أو (خبل) (١) -و (الخبل) (٢) الجرح- فهو بالخيار بين إحدى ثلاث: فإن أراد الرابعة فخذوا على يديه: أن يقتل أو يعفو (أو) (٣) يأخذ الدية، فمن فعل شيئا من ذلك فعاد فله نار جهنم خالدًا مخلدًا فيها أبدا" (٤).
Hazrat Abu Shurayh Khuza'i narrates that the Messenger of Allah, peace and blessings be upon him, said: If a person is killed or wounded, then he has a choice among three things. If he intends a fourth thing, then restrain his hand. These actions are: to kill (in retaliation), to forgive, or to accept blood money. Whoever chooses one of these and then returns (to seek revenge again), for him is the fire of Hell, in which he will abide forever.
Hadith 29845
٢٩٨٤٥ - حدثنا أبو بكر قال: حدثنا أبو أسامة عن عوف عن حمزة (أبي) (١) عمر عن علقمة بن وائل عن أبيه قال: شهدت رسول اللَّه ﷺ حين (أتي) (٢) بالقاتل يجر في نسعته، فقال رسول اللَّه ﷺ: لولي المقتول: "أتعفو عنه؟ "، قال: لا، قال: "أفتأخذ الدية؟ "، قال: لا، قال: "فتقتله؟ "، قال: نعم، فأعاد عليه ثلاثًا فقال له رسول اللَّه ﷺ: "إن عفوت عنه فإنه يبوء بإثمه"، قال: فعفى، فرأيته يجر نسعته قد عفى عنه (٣).
Hazrat Wa'il narrates that I was present with the Messenger of Allah (peace and blessings be upon him) when a murderer was brought, being dragged by his straps. Upon this, the Messenger of Allah (peace and blessings be upon him) said to the guardian of the slain: "Will you forgive him?" He replied, "No." The Prophet (peace and blessings be upon him) said, "Will you accept blood money?" He replied, "No." The Prophet (peace and blessings be upon him) said, "Will you kill him?" He replied, "Yes." The Prophet (peace and blessings be upon him) repeated this three times. Then the Messenger of Allah (peace and blessings be upon him) said to him: "If you forgive him, he will bear the burden of his sin." The narrator says: So the man forgave him, and I saw the murderer dragging a piece of his strap; indeed, he had been forgiven.
Hadith 29846
٢٩٨٤٦ - حدثنا أبو بكر قال: حدثنا أبو معاوية عن الأعمش عن أبي صالح عن أبي هريرة قال: قتل رجل على عهد رسول اللَّه ﷺ فرفع ذلك إلى النبي ﷺ فدفعه إلى ولي المقتول، فقال القاتل: يا رسول اللَّه (١) ما أردت قتله، قال: فقال النبي ﷺ للولي: "أما (٢) إن كان صادقا ثم (قتلته) (٣) دخلت النار"، قال: فخلى سبيله، قال: وكان مكتوفًا بنسعة، قال: فخرج يجر نسعته، قال: فسمي ذا النسعة (٤).
Hazrat Abu Huraira narrates that a man committed murder during the time of the Messenger of Allah, peace and blessings be upon him. So this matter was presented before the Noble Prophet, peace and blessings be upon him. He, peace and blessings be upon him, handed him over to the guardian of the murdered person. The killer said, "O Messenger of Allah, peace and blessings be upon him! I did not intend to kill him." Upon this, the Noble Prophet, peace and blessings be upon him, said to the guardian, "If he is truthful and you kill him, then you will enter Hell." The narrator says: He let him go, that is, he forgave him, and the killer's hands were tied with a strap. So he left in such a state that he was dragging his strap, and he became known as 'the one with the strap.'
