Hadith 29693
٢٩٦٩٣ - حدثنا أبو بكر قال: حدثنا وكيع عن شعبة قال: سألت الحكم وحمادًا عن رجل رمى بنار في دار قوم فاحترقوا، قال: ليس عليه قود، (١) لا يقتل.
Hazrat Sha’bah says that I asked Hazrat Hakam and Hazrat Hammad about a person who threw fire into the house of some people and as a result those people were burnt. What is the ruling regarding him? Both of these gentlemen replied: There will be no qisas (retaliation) upon him; he will not be killed.
Hadith 29694
٢٩٦٩٤ - حدثنا أبو بكر قال: حدثنا وكيع عن عبد العزيز بن حصين عن يحيى ابن يحيى الغساني قال: أحرق رجل (تبنا) (١) في (قراح) (٢) له، فخرجت شرارة من نار حتى أحرقت شيئًا لجاره قال: فكتبت فيه إلى عمر بن عبد العزيز فكتب إليّ أن رسول اللَّه ﷺ قال: "العجماء (٣) جبار"، وأرى أن النار جبار (٤).
Hazrat Abdul Aziz bin Husain narrates that Hazrat Yahya bin Yahya Ghassani said that a man burned straw in his open land, and the flames of the fire spread until they burned something belonging to his neighbor. He says that I wrote a letter to Hazrat Umar bin Abdul Aziz regarding this matter, and he replied to me: The Messenger of Allah (peace and blessings be upon him) said: There is no compensation for the injury caused by an animal, and in my opinion, there will also be no compensation for the damage caused by fire.
Hadith 29695
٢٩٦٩٥ - حدثنا أبو بكر قال: حدثنا أبو داود عن شعبة قال: سألت الحكم ⦗٢٦٥⦘ وحمادا عن رجل أحرق دارًا، فأحرق فيها قومًا (قالا) (١): لا يقتل.
Hazrat Sha’bah states that I asked Hazrat Hakam and Hazrat Hammad about a person who set a house on fire and burned the people inside it. Both of them said: This person will not be killed.
