If a Man Deliberately Kills Another, He Is Imprisoned Until Retaliation Is Taken
Hadith 29589
٢٩٥٨٩ - حدثنا أبو بكر قال: حدثنا محمد بن يزيد عن أبي العلاء عن أبي هاشم (١) عن إبراهيم.
Ibrahim and Hasan Basri said: Regarding a man who was deliberately killed, and the killer was imprisoned so that he could be killed in retribution for the murdered person. Then a man came and mistakenly killed this killer, so his blood money will be given to the family of the prisoner, and Hazrat Ata said: The family of the first murdered person will receive his blood money.
Hadith 29592
٢٩٥٩٢ - حدثنا أبو بكر قال: حدثنا ابن مهدي عن حماد بن سلمة عن قتادة عن [الحسن قال: الدية لأهل المقتول.
Hazrat Qatadah says that Hasan Basri stated: The blood money (diyat) belongs to the family of the murdered person.
Hadith 29593
٢٩٥٩٣ - حدثنا أبو بكر قال: حدثنا ابن مهدي عن حماد بن سلمة عن] (١) حماد مثل قول الحسن.
A similar statement has also been narrated from Hammad as from Hasan Basri.
